This legal notice applies to all purchases made by you through the website under the domain name brightoncraft.com (the “website”). By offering to purchase products through the website you are entering into an agreement with Brighton Craft Fair on the terms and conditions set out below. These terms and conditions of sale are additional to and not a substitute for the general terms and conditions of booking which can be found brightoncraft.com/terms-conditions

1. Purchase of products from Brighton Craft Fair, On line.

The descriptions on the website, of the products supplied by Brighton Craft Fair are necessarily subjective but are intended to give a general description of the products to the best of our knowledge. Brighton Craft Fair warrants that it has the right to supply all products offered by it on the website.

In all other respects and to the maximum extent permissible, Brighton Craft Fair makes no other warranties or promises about the products, and any implied warranties are excluded.

1 a) Availability, prices and information on products

All products are offered for sale by Brighton Craft Fair subject to availability. The price of the products shall be the price listed in UK pounds sterling on the website on the date of your order (inclusive of VAT & Excise Duty, but exclusive of delivery charges which are payable by you). All prices displayed on the website are and must be paid in full, including delivery charges, except where discounts are offered as detailed on the website.

1 b) Ordering

When you send us an order e-mail, Brighton Craft Fair will treat the order as an offer by you to purchase the products subject to these terms and conditions of sale. You are responsible for ensuring the accuracy of your order and any specific requirements and if Brighton Craft Fair accepts your offer they shall supply you, subject to availability, with the quantity and specification of products set out in your order.

If Brighton Craft Fair accepts your offer they shall confirm each order online via the internet or by email and such confirmation shall be Brighton Craft Fair's acceptance of the contract between the parties.

1 c) Delivery & retention of title

All products will be delivered to the address that you indicate on the “Checkout” page and so far as possible in compliance with any specific delivery instructions, referred to above. Most orders are received within 5 working days. Please allow 28 days for delivery. We will do our best to send out your order as quickly as possible.

Whilst the risk of damage to or loss of the products shall pass to you the purchaser upon leaving the premises of Brighton Craft Fair, title in the goods shall not pass until the whole purchase price including the cost of transport, has been paid in full.

Any times quoted for delivery are approximate only and time shall not be of the essence. Brighton Craft Fair shall not be liable for any delay in delivery of the products howsoever caused.

Brighton Craft Fair shall confirm each order in writing by sending you a printout of the order along with your products.

1d) Returns

If any of our products fall below the high standards you expect please return them within 28 days and we will refund or exchange the item. Please have your invoice with you to do this. If you change your mind within 28 days, we are happy to refund or exchange the product provided it is returned, as sold, with all the original packaging, tags, labels and accessories. Please have your order confirmation email with you to do this. We will not refund the costs of return postage to us unless the products are faulty.

2. Personal data

When you make a purchase from this website, the personal information collected enables us to process and deliver your order. By registering your details on our website, you consent to the recording, holding and using the personal data we collect about you. Nothing contained in this clause or elsewhere allows us to retain credit card details which we do not retain. We are committed to the Data protection legislation and completely dedicated to the privacy of our customers information.

3. Limitation of liability

Brighton Craft Fair's liability to you is limited to the price of the products purchased and the delivery cost involved and in particular is not liable to you for any indirect or consequential loss (including without limitation financial loss such as loss of profit, or otherwise) that you may incur as a consequence of its failure to comply with these terms and conditions of sale.

4. Changes to the terms and conditions of sale

Our terms and conditions of sale may be changed. Please review them regularly. If you continue to use the website after a change has been made you are deemed to have accepted it.

5. Law and jurisdiction

These terms and conditions of sale shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in relation to the website shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any of these terms or conditions of sale should be determined to be illegal, invalid or otherwise unenforceable, it shall be deemed deleted and the remaining terms and conditions shall survive and continue to be binding and enforceable.

Goods for sale

  • All crafts and artwork must be your own original creations and only available as limited editions
  • All stall displays, stands and artwork must be safe, inoffensive and portable
  • Brighton Craft Fair has the right to ask Exhibitors to remove any of their exhibits and to make alterations to their display if they are deemed unsuitable, create a hazard or for any other legitimate reason
  • Failure by the Exhibitors to take remedial action on this last point may result in the promoters of Brighton Craft Stall asking the Exhibitor to leave and to refuse admission without refund of fees for future fairs
  • All artwork and personal belongings are the responsibility of the Exhibitor

Use of Friends Meeting House main hall

  • No sellotape, drawing pins, or fixings of any description are permitted on the paintwork or walls of the Friends Meeting House. Blutack ONLY is permitted on the wooden panelling. Exhibitors may however make use of existing hooks, shelves, etc. for their work.
  • No display is allowed above or on the wooden panelling, except light cardboard mounts
  • No materials of any description are allowed on the piano
  • Electrical installations may only be used with prior agreement and may be subject to extra charge
  • We recommend that all electrical equipment be PAT certified for use
  • No naked flames are permitted in the Friends Meeting House building
  • No food or drink, other than water is permitted in the main hall

Booking procedure

  • Bookings are only accepted after an Expression of Interest Form has been received and approved by the Brighton Craft Fair promoters
  • Not all applications will be successful, as we need to have a good mix and quality of arts and crafts. Brighton Craft Fair reserves the right to refuse applications without having to justify its decision
  • All bookings will be taken on a first come, first served basis
  • Bookings will only become effective when Brighton Craft Fair receives your booking form and payment.
  • Allocation of spaces at the venue is at the sole discretion of Brighton Craft Fair
  • Confirmation of your booking will be sent by email
  • Should the Fair become over-subscribed, applications will be placed on a waiting list and Exhibitors informed no less than one week in advance of the fair if a cancellation has been received.
  • Receipts for payment of stall will be issued if required. Please ask.

Indoor Stall arrangements

  • Tables are provided (measuring 5’ X 2’) and two chairs for each table
  • Exhibitors may begin setting up from 9am and should have their stalls completed for public opening at 10am
  • Packing up of stalls is not permitted before 4.30pm
  • Sharing of stalls is only allowed subject to all Exhibitors being approved to exhibit through the normal Expression of Interest procedure

Outdoor Space arrangements

  • Size of outdoor space is limited to 9m2 (3m width x 3m length) and will be allocated by the promoters
  • Exhibitors who book space for the Meeting House garden will need to bring their own table(s) and are permitted to erect temporary gazebos
  • We strongly advise Exhibitors to plan for inclement weather to protect themselves and their goods and possessions. Please note we do not offer any gazebos or other weather protection
  • Outdoor Exhibitors may only change to an indoor stall on a “first come, first serve” basis, subject to available space and a £5 surcharge. (We cannot guarantee that we can provide an indoor space in the event of poor weather)
  • Exhibitors may begin setting up from 9am and should have their stalls completed for public opening at 10am
  • Packing up of stalls is not permitted before 4.30pm
  • Sharing of stalls is only allowed subject to all Exhibitors being approved to exhibit through the normal Expression of Interest procedure
  • No electricity will be provided in the garden

Cancellations

  • If for whatever reason, the fair has to be cancelled, or your stall is no longer available, a full refund will be made to you
  • Exhibitor Cancellation Policy:

-Cancellations must be received in writing

-No refund is possible if the cancellation is made less than one month before the fair date. Notification of more than one month will receive a 50% refund

-Space cannot be re-let without prior approval from Brighton Craft Fair

Insurance

  • Brighton Craft Fair provides public liability insurance to cover running of the fair, but all Exhibitors are also recommended to take out their own insurance to cover loss or damage to their own goods and possessions.
  • Brighton Craft Fair cannot be held responsible for injury or accident caused by a Exhibitor's product or exhibit, loss of profits, for damage or theft of Exhibitors’ stock or interruption of power or services

Loading and unloading

  • No parking facilities are available at the Friends’ Meeting House. Those stopping outside the building to load and unload their vehicles do so at their own risk of theft or prosecution.
